Contractual conditions within the scope of\npurchase contracts<\/p>\n\n
between<\/p>\n\n
Anja\nKarboul, Schulstr. 6, 13187 Berlin, USt-Identifikations-Nr.: DE 262922741 – hereinafter referred to as “Provider” –<\/p>\n\n
and<\/p>\n\n
the customer designated in \u00a7 2 of the contract – hereinafter referred to as the “Customer”\n<\/p>\n\n
are concluded.\n<\/p>\n\n
\u00a7 1 Scope of application, definitions\n<\/p>\n\n
(1) The business relationship between the Supplier and the Customer shall be governed exclusively by the following General Terms and Conditions in the version valid at the time of the order. Deviating general terms and conditions of the customer are not recognized unless the provider expressly agrees to their validity in writing.\n\n\n \n\n<\/p>\n\n
(2) The customer is a consumer insofar as the purpose of the ordered goods and services cannot be predominantly attributed to his commercial or independent professional activity. In contrast, an entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding the contract, acts in the exercise of their commercial or independent professional activity.\n\n\n \n\n\n<\/p>\n\n
\u00a7 2 Conclusion of contract\n<\/p>\n\n
(1) The customer can select products, in particular art prints, from the provider’s range and initiate the order process by clicking the “order” button. The “order” button generates an e-mail with a sample text expressing the customer’s interest in a specific product. The e-mail also contains a hyperlink to the current terms and conditions. The customer can edit the e-mail and order the desired product. The contract is only concluded when the provider issues a declaration of acceptance, which is sent in a separate e-mail (order confirmation). In this e-mail or in a separate e-mail, but at the latest upon delivery of the goods, the contract text (consisting of the order, GTC and order confirmation) is sent to the customer (contract confirmation). The text of the contract is stored in compliance with data protection regulations.\n \n \n\n \n \n \n\n \n\n\n \n<\/p>\n\n
(2) The contract is concluded in German.\n<\/p>\n\n
\u00a7 3 Delivery, availability of goods\n<\/p>\n\n
(1) Specified delivery times are calculated from the time of receipt of payment. If no other delivery time is agreed, it is up to 14 calendar days.\n \n<\/p>\n\n
(2) If no copies of the product selected by the customer are available at the time of the customer’s order, the supplier shall inform the customer of this immediately in the order confirmation. If the product is permanently unavailable, the supplier shall refrain from issuing a declaration of acceptance. In this case, a contract is not concluded.\n\n\n \n \n<\/p>\n\n
(3) If the product specified by the customer in the order is only temporarily unavailable, the supplier shall also inform the customer of this immediately in the order confirmation.\n\n\n<\/p>\n\n
(4) The following delivery restrictions apply: The supplier only delivers within Germany.\n\n<\/p>\n\n
\u00a7 4 Retention of title\n<\/p>\n\n
The delivered goods remain the property of the supplier until full payment has been made.\n\n<\/p>\n\n
\u00a7 5 Prices and shipping costs\n<\/p>\n\n
(1) All prices stated on the provider’s website include the applicable statutory VAT and shipping costs.\n\n\n<\/p>\n\n
(2) The goods are dispatched by post. The shipping risk is borne by the provider if the customer is a consumer.\n \n<\/p>\n\n
(3) In the event of a revocation, the customer shall bear the direct costs of the return shipment.\n\n<\/p>\n\n
\u00a7 6 Terms of payment\n<\/p>\n\n
(1) The customer must make the payment in advance by bank transfer or Paypal.\n<\/p>\n\n
(2) Payment of the purchase price is due immediately upon conclusion of the contract.\n<\/p>\n\n
\u00a7 7 Warranty for material defects\n<\/p>\n\n
The provider is liable for material defects in accordance with the applicable statutory provisions, in particular \u00a7\u00a7 434 ff. BGB. The warranty period for goods delivered by the supplier to entrepreneurs is 12 months.\n\n \n<\/p>\n\n
\u00a7 8 Liability\n<\/p>\n\n
(1)\nAnspr\u00fcche des Kunden auf Schadensersatz sind ausgeschlossen. Hiervon\nausgenommen sind Schadensersatzanspr\u00fcche des Kunden aus der Verletzung des\nLebens, des K\u00f6rpers, der Gesundheit oder aus der Verletzung wesentlicher\nVertragspflichten (Kardinalpflichten) sowie die Haftung f\u00fcr sonstige Sch\u00e4den,\ndie auf einer vors\u00e4tzlichen oder grob fahrl\u00e4ssigen Pflichtverletzung des\nAnbieters, seiner gesetzlichen Vertreter oder Erf\u00fcllungsgehilfen beruhen.\nWesentliche Vertragspflichten sind solche, deren Erf\u00fcllung zur Erreichung des\nZiels des Vertrags notwendig ist.<\/p>\n\n
(2) In the event of a breach of material contractual obligations, the Provider shall only be liable for the foreseeable damage typical of the contract if this was caused by simple negligence, unless the Customer’s claims for damages are based on injury to life, limb or health.\n\n\n\n<\/p>\n\n
(3) The restrictions of paragraphs 1 and 2 also apply in favor of the legal representatives and vicarious agents of the provider if claims are asserted directly against them.\n \n\n<\/p>\n\n
(4) The limitations of liability resulting from paragraphs 1 and 2 shall not apply if the provider has fraudulently concealed the defect or has assumed a guarantee for the quality of the item. The same applies if the supplier and the customer have reached an agreement on the quality of the item. The provisions of the Product Liability Act remain unaffected. <\/p>\n\n
\u00a7 9 Data transfer to third parties – subcontractors
\u00a7 10 Cancellation policy\n<\/p>\n\n
(1) Consumers generally have a statutory right of withdrawal when concluding a distance selling transaction, about which the provider provides information below in accordance with the statutory model. The exceptions to the right of withdrawal are regulated in paragraph (2). A sample withdrawal form can be found in paragraph (3).\n\n\n \n <\/p>\n\n (2) The provider provides the following information about the model withdrawal form in accordance with the statutory provisions:\n\n<\/p>\n\n \u00a7 11 Final provisions<\/p>\n\n (1) The law of the Federal Republic of Germany shall apply to contracts between the provider and the customer to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
